PixoChat is made by Rare Theory LLC. These terms are the deal between you and us when you use the PixoChat app for iPhone and the PixoChat website. Our Privacy Policy explains what we collect and why, and our Community Guidelines explain what you may not post. Both are part of these terms. If you do not agree to them, do not use PixoChat.
1. The short version
You have to be at least 13. You own what you draw. Be decent to people. What you post somewhere public can be seen and, where the app allows it, kept by other people, and deleting the original does not take their copy back. We can remove content or accounts that break the rules. We do not show ads, we do not sell your data, and there is nothing to buy in PixoChat today; if that changes we will update this page first. You can delete your account any time.
2. Who we are
Rare Theory LLC is a limited liability company in Wisconsin, United States. Our mailing address is 1560 Woodvale Drive, Oregon, WI 53575. You can reach us about anything on this page at hello@pixochat.app.
3. Who can use PixoChat
You must be at least 13 years old. When you sign up you enter your date of birth; if it shows you are under 13, no account is created and nothing about you is kept. Entering a false date of birth is a breach of these terms. We may pause new sign-ups for a while; if we do, you can wait in the app until there is room.
You may not use PixoChat if the law where you live does not allow you to, if we have permanently closed an account of yours for breaking these terms, or if you are in a country under a United States embargo or on a United States government list of prohibited or restricted parties.
4. Your account
You sign in with Sign in with Apple or with an email address and password. You are responsible for what happens on your account, including the drawings and messages sent from it, and for keeping access to the Apple ID or email address it is tied to. If you lose that access we may not be able to prove the account is yours or give it back to you.
One person, one account. Do not share, sell, rent or give away an account, and do not create accounts for other people or by automated means.
5. Your licence to use the app
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the PixoChat app on Apple devices that you own or control, for your own use, under these terms and the App Store's rules. That is all the licence covers. The app, its code, its art, its sounds and everything else we made stay ours.
Unless the law where you live says otherwise, you may not copy, change, translate or make derivative works from the app; reverse engineer, decompile or try to recover its source code; sell, rent, lend or sublicense it; remove or hide any copyright, trademark or other notice in it; get around or interfere with its security or its checks that a request comes from a genuine copy of PixoChat; use bots, scripts or automated tools to access it or to collect information from it; put an unreasonable load on it or the servers behind it; or use it to build a competing product.
6. What you may not do
The Community Guidelines are the full list and are part of these terms. In short: no harassment, threats or hate; no sexual content of any kind, and nothing that sexualises anyone under 18; no gore for shock; no scams, spam, phishing or impersonation; no selling or promoting illegal goods; no publishing other people's private information; nothing that infringes someone else's rights; and no cheating, hacking, scraping or interfering with the service or other people's accounts.
7. What you make
You own the drawings, messages, notes and anything else you create in PixoChat. You are responsible for it and you promise you have the right to post it.
So that PixoChat can work, you give Rare Theory LLC a non-exclusive, worldwide, royalty-free licence to store, copy, send, display, resize and back up your content, only as far as is needed to run, secure, moderate and improve the service and to show it to the people you have chosen to show it to. This licence does not make your content ours. We do not use it to train AI models, and PixoChat has no generative AI features. It ends when you delete the content or your account, except for backup copies that clear on their own schedule, records the law makes us keep, and the copies described in the next section.
When you have Sensitive Content Analysis turned on in your iPhone settings, drawings sent to you are checked on your device by Apple before they are shown to you, and a drawing that is flagged stays covered until you choose to view it. That check runs on your phone, not on our servers. Photos are different: a profile photo or a photo print is checked on our servers, by Google Cloud Vision, before it appears. Your display name and bio are also checked on our servers before other people see them.
8. What other people can keep
Some parts of PixoChat are private, some are shared with friends, and some are public. Where the app lets other people keep, save, collect, trade, buy or forward something you made, their copy is theirs to keep. A friend's copy of a chat you had together stays in their app. Something you posted somewhere public can be seen by anyone, and where the app lets people keep it, deleting your original does not recall the copies. Think about this before you post, and do not put anything in a public space that you would not want a stranger to have.
9. Moderation, enforcement and appeals
We may remove or hide content, restrict what an account can do, suspend an account, or close it, when we reasonably believe that content or behaviour breaks these terms, the Guidelines or the law, puts people or the service at risk, or when the law requires us to act. Which of those we do depends on how serious it is, whether it has happened before, and who could be harmed. We will tell you when we act against your account unless the law forbids it or telling you would put someone at risk; a warning, or content of yours we removed, arrives as a note in your Activity. If we suspend or close your account, the app tells you when you open it, and the content reported may be removed at the same time. A closed account leaves its friends' lists, and its one-to-one chats stay readable but take no new messages. Where the law requires, we report illegal content to the appropriate authorities.
A report keeps a copy of what was reported (the message, or a Studio's photo and bio as they were) so it can be reviewed even after the original is gone. The person reported is not told who reported them. Removing someone as a friend, or blocking them, ends your one-to-one chat with them: it stays readable, but neither of you can send anything new until you are friends again.
If you think we got it wrong, email hello@pixochat.app with your friend code and what happened. A person reads every appeal. Reports and the decisions taken on them are kept as described in the Privacy Policy so that repeated behaviour can be recognised.
10. Copyright complaints
If you believe something on PixoChat infringes your copyright, send a notice to our designated agent: Lance Peterson, Rare Theory LLC, 1560 Woodvale Drive, Oregon, WI 53575, hello@pixochat.app. Your notice must include: what work you say is infringed; where the infringing content is in PixoChat (a friend code and a description are enough); your name, address, phone number and email; a statement that you believe in good faith the use is not authorised by the rights holder, their agent or the law; a statement, under penalty of perjury, that the notice is accurate and that you are the rights holder or authorised to act for them; and your physical or electronic signature. We take down content named in a proper notice and tell the person who posted it, who may send a counter-notice under the same law. Accounts that repeatedly infringe are closed.
11. Our stuff
PixoChat, the PixoChat name and mark, the app, the website, the art, the characters, the sounds and the writing are owned by Rare Theory LLC or licensed to us. Nothing here gives you any of it beyond the licence in section 5. Do not use our name, marks or art without our written permission, and do not use PixoChat or its materials to make a competing product.
12. How PixoChat is paid for
PixoChat shows no third-party advertising and there is nothing to buy in it today. We may add paid features in the future. If we do, we will update these terms and the Privacy Policy before they go live, and anything you can buy will be described plainly, including what happens to it if you delete your account.
13. Changes to the app
We may add, change or remove features, and some features may be experimental or available only to some people. Updates may install automatically depending on your settings, and some updates may be required to keep using PixoChat. Where the law requires, we will give notice before removing something that matters.
14. Ending things
You can stop using PixoChat any time, and you can delete your account from Settings, or from the screen the app shows when your account is paused, closed, waiting for sign-ups to open, or needs an update. Deleting it ends your friendships straight away; the Privacy Policy says what happens to the rest. We can suspend or close your account for the reasons in section 9, if you break the law, if your use creates a legal or safety risk for us or other people, if the law requires it, or if we shut PixoChat down. Sections about content, our stuff, no warranty, limits on liability, and governing law keep applying after an account is closed. Nothing here takes away rights the law gives you that cannot be waived.
15. Apple
These terms are between you and Rare Theory LLC, not Apple. Apple is not responsible for PixoChat or its content, and has no obligation to provide maintenance or support for it; we do. If the app fails to meet a warranty that the law does not let us exclude, you may tell Apple and Apple may refund the purchase price, if any; beyond that Apple has no warranty obligation for the app. We, not Apple, are responsible for handling any claim relating to the app, including product liability claims, claims that it does not meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone's intellectual property. Any third-party terms that apply to a feature also apply to your use of it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also follow the App Store's terms.
16. Privacy
Our Privacy Policy at pixochat.app/privacy explains what we collect, why, who else touches it, how long we keep it and how to delete it. It is part of these terms.
17. No warranty
To the extent the law allows, PixoChat is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that PixoChat will always be available, uninterrupted, error-free or secure, that content will always be kept, or that any feature will stay. We are not responsible for what other people post. Nothing here excludes a warranty or right that the law does not let us exclude.
18. Limits on liability
To the extent the law allows, Rare Theory LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from your use of or inability to use PixoChat, from content posted by you or other people, from loss or deletion of content, or from changes to or the ending of the service. To the extent the law allows, our total liability for all claims relating to PixoChat or these terms is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars. Some places do not allow some of these limits; there, our liability is limited as far as the law allows.
19. Your rights, governing law and disputes
If you are a consumer, the law of the country or state where you live may give you rights that these terms cannot take away, and nothing here tries to. Otherwise these terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules, and any dispute about them or about PixoChat will be brought in the state or federal courts in Dane County, Wisconsin, which you and we agree have jurisdiction, except that either of us may bring a claim in small claims court where it qualifies. Before going to court, email us; most things can be sorted out with a conversation.
20. Changes to these terms
When we change these terms we update the date at the top. If a change matters to you, we will tell you in the app before it takes effect and, where the law requires, give you a chance to read it first. Using PixoChat after a change takes effect means you accept it, as far as the law allows. If you do not, delete your account.
